I'm sky until morning at nights on WW LAM and FM for Tommy Tucker welcome to our show tonight. There is a lot to talk about tonight civil unrest continues in Egypt and I think it's interesting to look closely at the role of the social media. In this uprising against the president of -- they're upset when my unemployment. They're not happy with the president and there. Very upset with the rising cost of things like food. -- there are a lot of those things about this that parallel things going on in this country but this would never happen in America or would it. The -- the social media actually parallels the role of mass media and the basic Internet. In the collapse of communism back in the 1980s I assure you were called it to president Ronald Reagan was credited by many as single handedly. Bringing down communism. He got credit for it but his. Timing was darn good because it was really the mass media. Italy the real foundation for the end of communism in the Soviet Union eastern and in Central Europe so will -- will get into that -- with among others not only you but also -- A social media expert. And will just talk about whether or not also the US is involved in. In this uprising in in Egypt and if you're from Egypt or if you have ever been to Egypt I would love to talk to you on -- -- tonight. And done a home order in Baton Rouge has been arrested after he shot and killed an intruder who give you the details and we'll talk about whether or not that was justified. You know you you did the basic rules of thumb when it comes to shooting an intruder or a carjacker. Is that you must feel insecure life is threatened when we give you the specifics of the homeowner in Baton Rouge who's been arrested after shooting killing an intruder. You may ask the question well maybe he wasn't really threatened they'll talk about that later in the show. And today a federal judge in Florida has declared Obama's Health Care Reform bill. Unconstitutional. Should listen. -- applause Farrell a lot of people were applauding right now but does everybody. This debates will certainly end up with the Supreme Court there -- find most interesting about this ruling today. Is that it is a federal judge. Who was appointed for life. And seemingly. Above ruling on issues for political reasons. Seemingly a federal judge or Supreme Court justices for that matter. Is they're poised for life. Are. Ideally. Above. Judging. Based on prevailing public opinion. And isn't that a good thing in this country. What you agree or disagree isn't that good to have judges and justices who. Again our seemingly. Above. Political motivation. Making judgments on what is constitutional and what is a constitutional. We we we talked about this what -- I did a show WWL shortly after a proposition nine. Which was the proposition which is on the ballot in the state of California. And he -- called the ruling wise to people in California voted. Remove the majority to ban gay marriage. Well of a federal judge in California ruled that that was unconstitutional. And what I did was try to bring this back to the discussion of what this country was like during segregation. If there was a time in this country when blacks couldn't marry whites. There was a time this country would blacks didn't have the rights they have today. You could have taken a state like Louisiana Mississippi Alabama Georgia Texas and Arkansas and many others say and I don't wanna. I don't -- indict all of these states but there was a time in this country not that long ago. When a state would have passed and would have passed. A proposal. Banning. Integration. And yet that's unconstitutional that's the job of federal judges that's the job of the Supreme Court to make those rulings. That sometimes supersede the will of the people. You'll remember in civics there are three branches of government. The executive branch the president signs the laws president doesn't make the laws he signs the laws. It is congress the legislative branch that makes creation passes the laws and it's the judicial branch the supreme courts that interpret the laws. We need these laws interpreted based on. The spirit of the constitution and this is one of the great things about the constitution. There -- a lot of things that are legal in this country that you might not like. Abortion for example I don't wanna get into that debate I'm just using this as an example. And ultimately the Supreme Court will rule whether you agree with astronaut and I'm not asking you to change your relate your religious beliefs. But whether you agree with it or not the Supreme Court will rule. Vet gay marriage is constitutional. That two men and two women can not civil union but can marry. This is my -- didn't. Legal opinion by the way but this will happen the Supreme Court. Will ultimately face this decision. And they will rule that based on the constitution and right to privacy and a ban on gay marriage is unconstitutional. So when it comes to the suit when it comes to be ultimately the Supreme Court ruling in this federal judge ruling in in Florida are declaring Obama's Health Care Reform bill unconstitutional. It seems to me that. This is this is a good thing this is what judges are supposed to do they're not supposed to judge something based on popular opinion. They're supposed to judge based on what they find constitutional. And unconstitutional. I'm -- in the morning at night when WWL I am FM for Tommy Tucker. If you wanna join us would come at call 5042601870. That's 2601870. In isn't it good. That. Judges and justices rule on bills and laws without regard for public opinion at the time because the constitution is timeless. The constitution doesn't take into consideration how the public feels. Right now in 2011. Or didn't take into consideration how the public -- in 1960. When it came to immigration. Shouldn't judges and justices rule when bills without regard to public opinion this is a good thing in my opinion. 260187. -- toll free 866889. Zero except to your comments coming up next -- -- WL. I said a moment ago that these. Federal judges -- Supreme Court justices are seemingly. Beyond and above politics when they when they rule on what is constitutional what is not constitutional. I would be remiss if I didn't tell you that. The judge today judge sure Roger Vinson senior judge appointed by Ronald Reagan. Is in Pensacola. Now Florida is is is two different states there is. Central Florida. And the panhandle the panhandle is very very conservative it borders Alabama. A Georgia and the panhandle of of a Florida is an extremely. Strong bastion of of and and conservatives not that there's anything wrong with that they certainly have a right to be that way but Florida is an interesting state South Florida is certain is much more -- and I democratic or Democrat then becomes a democratic a democratic and band as sections of Florida so. But here's and here's a federal judge -- point of Ronald Reagan who strikes down Obama is. Healthcare bill. In December judge Henry. The Health Care Reform bill unconstitutional so. I've two judges supported by Republicans find it unconstitutional. Interestingly two other federal judges named by Bill Clinton and Democrats have upheld the deal. So it and it it bothers me night you know I think we need to bring this into -- discussion as well. It bothers me that these judges. But it is seemingly above. Politics are actually voting along political ideology lines which. Which I don't like. It -- I've been quite often the Supreme Court and I think that it does. Tend to look beyond the politics of things and I think a lot of -- the Supreme Court collectively. You know there certainly individuals on the Supreme Court it will rule based on more on politics than than others but collectively as. Essar as a ventures is a group of justices to Supreme Court potential look at things beyond public opinion and tends to focus on what is constitutional and what is not constitutional. And I think that's a very very positive thing. It is unfortunate though that if these. Judges are going to be. Aligned with political parties Republicans Democrats because that's who appointed them. I would like to think. And I really don't think that I'm my nineties and this perhaps I am but I don't think I'm naive I would like to think. That these judges are. Are basing this on what is what is constitutional and what is not and I guess the real key is. This judge's ruling today said that congress cannot. Force. Americans to buy health care insurance. However if you don't have health care insurance and you get sick you want the government to take care of you don't you so is. Is that fair. Is it a little bit like. Flood insurance in this part of the country you don't have to buy flood insurance. But be honest with downs and it it and be -- it yourself if if your flooded. You want the government committed take care -- don't you. 260. When he seventy and toll free 8668890870. Among other things tonight. We're talking about this federal judge in Florida today declaring Obama's Health Care Reform bill. Unconstitutional. This will certainly end up with the Supreme Court and I don't know whether you heard about this this week are not. But or maybe it was obviously and he was late last week. There's a woman in Pennsylvania who was walking in a mall while texting. I'm laughing because I've I've I've seen the YouTube video of this from surveillance cameras. This woman was walking in the mall and texting. She fell into a phone. And sheep sheep and begun -- -- was embarrassed and that that she is suing the malls. Because the security guards. Laughed. And her friend for falling in -- and the found what she was texting. She said they -- helped me out. She apparently wasn't hurt she got a immediately wrestled a video -- -- it did look like they were guards standing basket you're sitting right there to help her out. Bites today. Should this woman be suing the mall because security guards laughed at her wind. When did we lose our right to last that stupid acts and and here's a woman who is embarrassed and she immediately goes to the system of a code of justice in this country wants to go to court wants to sue. Because security guards laughed at her look lady. You were stupid okay you did something really stupid maybe you're not stupid but you did something really stupid you were texting and walking. I just fell into you fell into a fountain animal if I would dare I would've been laughing my butt off. It's funny and you should take a look at yourself in the mirror and instead of suing the mall. Seems to me that maybe you should learn to laugh at yourself read it. It it's so disturbing how many frivolous lawsuits there are in this country and this is something that did it goes on every day we talk about this on and off all the time. A talk radio and on television but texting and walking falling in a mall and you're suing the the mall because security guards -- that -- Now more disturbing then backed. -- is the fact that the State of New York. And the state of Arkansas. Are considering. Legislation. That would make it illegal. To text. And walk. At the same time. Now. I understand the law about texting and driving. Is dangerous I admit. I do it. I shouldn't do it in fact I admit. -- probably shouldn't do this I've I've been I guess like -- could be. Arrested when -- leave the studio tonight at at midnight but I'm gonna admits that I still. Occasionally. Text and drive I shouldn't do it we shouldn't wait for a law to be passed that causes us to do what we should do. It we shouldn't have laws that are passed two protect us from ourselves. -- at -- this law about -- and -- we knew the texting and and driving usage texting and I walk I mean talking on the phone. And driving your car is dangerous and looking down you can look -- detection can read a text you just can't text or reading a text is dangerous. And I find myself. Attempting to entrap people friends of mine people I know I know they're driving at the time and I will text them and I expect them to text me back. We are not. Sensible people in May we are not a sensible species. In in many ways we do things that we know -- dangerous and then and and that and that that we would get -- it was a big bad habits. We really need to take more personal responsibility and accountability for. For our own actions and and and this texting and watch. Ban against texting and walking but I know it's inconvenient but if so watch -- -- somebody's walking down the mall and it's a little inconvenient when somebody and and I'm among them. He's walking in and looking -- we should. Texting and one we should we go so far as to ban texting and walking. Again a comment on that -- to comment on it coming up later cannot let this show go without making a comment on up on -- -- -- -- when I I I think about the good that texting and I've -- the other day I again I I I don't like to admit this but I I'm always honest with you on on this show when I'm on the air. I admit. But I still occasionally and text mainly at red lights. But if I have to start all all I'll continue they'll start forward in the car while I'm finishing up the text it's -- I'm stupid for doing that. -- -- and I'm I'm I'm I guess I'm setting a bad example by admitting to spread. If you if you do it -- maybe you're not a position to admitted to publicly. But I think I'm content and touching on what a lot of people are doing anyway. You know I find it interesting that that I try to hide it because I don't want other drivers to see me doing it. You still texting and driving me that we can admit or anywhere order tricycle and sent got your house of during. If you saw a person who look like they were obviously drinking and driving would you report that. Are we going to ever get to that the point where we start reporting. Those who we see texting and driving at the same time and then. Texting and walking is this maybe I'm missing something but it doesn't seem like this should take up. New York and Arkansas two states two very different states are considering. Legislation that would ban texting. And walk. Okay you know. One thing I want to say about the woman who -- -- -- I don't know decrepit talking about I didn't actually see it but I've seen it posted all over the plate on the Internet. And I think for people that has a lot to do with that because. It's important for the Internet the only people that would know she fell. Would be personal the security guards and the fifteen people let this happen and those that mention selanne. But the -- -- the Internet the coast people posted video on the Internet now it's nationwide now it's what what are not excuse me not being ridiculous. Illegal as of a couple of months ago. So we really -- we really have no justification for doing it and you know I do I don't drink and drive on smart enough not to do that. So. I don't know how I can justify texting and driving and and I guess. It's gonna have to get to the point where. More bad things happen before we all realize how dangerous it is. She is suing them all because the -- security guards left her new York and Arkansas are now considering. Passing legislation that would ban texting. And walking -- I just thought about something else this this dangers -- your driving. What about guys. Who take a look at attractive women. On the side of the road walking along a street walking along a sidewalk guys who take a look at -- -- attractive blonde in the cart or brunette or redhead. In the car next to them is that -- -- why don't we ban. Looking at attractive with if women don't look at attractive man. Media in general I mean you might be a woman who you know checks out -- checks are guys but in general. Men don't look at women. Women. Men don't women. When they get this straight here men. Look at women women don't check out men in the same way. I I I can think of first times that I've been walking down the mall and are not texting by and I might turn to. Look at somebody who's passed on the other side whose parents might turn around to loving and a guy who -- -- turned to look at or a girl. And maybe almost bump into somebody so maybe we -- or -- right into -- old you are walking -- if I walk into a pole I only heard myself. If I walk into somebody else -- hurt them. Why it's built into a car in the air era -- -- through my belt or herbal duplicate under their belt on out. -- cell phone about the back seat where even edit email or act -- act that I. But Caylee -- you're nineteen years old and you're mentally. And physically capable. Of texting and driving much more than I am because I'm older than you. And I grow up -- that technology and it I I I I fumble with a little more than I should now you have this technology so -- news. If I don't have the technology how could you explain. You can bring up a text message instant text messages are long enough to distract your attention you just can't. You can't and send a text message while you're driving I think reading a text message what you're gonna eat what you muscle pull out an article sometimes and and and read an article. They're taping their current reading -- -- -- pitch fork and want to hear that the air that it can't help. You cannot -- -- -- into the right the pitcher work and look congress they are acting or alcohol now their -- people it can't talk on the Iraq thing. Well let me ask -- There's some people who can't chew gum and walk and maybe we should pass an ordinance against that. Exactly but it you know what it's -- And they understand how they they try and stay there. They they try to make it illegal. There's not mean he called her up -- opt for protecting I think it's darn it I'm not letting you partly that we not let off the ballot but not bomb the pop art at all. -- don't they have the ability to two to check your phone and see if he just made a text if you just sent a text. While -- here in the opera. And yet he felt that it aria is back out that they have no record you ever get any -- -- -- -- that's -- that's a bit more. Think he did spend one era LL. I know what that stands for. I. But we've learned so much about drinking and driving we didn't used to think that as a as a society we used to my parents used to drink and drive all the time my parents would would bring glasses from home or from a party and they would be in the -- not even go cups and of course. In this city we had to go cups which nobody else around the country understands. So drinking and driving has been almost part of this culture but it's a very very very dangerous thing what's gonna have to happen before we all realize that texting and driving. Is really dangerous. And yeah I have yet take a bow on the air that I never gonna do it again and I admit that I I I continue to do it knowing knowing that it's dangerous. An extra ten compare the -- so quick it's so easy. It's so easy to -- it's a bad -- it -- better when you get. Now don't get your ES -- don't think we should I don't think we should expect the government to pass laws or or our our blue legislative branch real locally and nationally to pass laws to protect us from ourselves but yet that's kind of what we do week. We know texting is. It's dangerous so we driving that we do what we knew that drinking and driving was dangerous and yet we did a course that was always -- it was always against the law -- the threshold of that has certainly changed dramatically. We know all along that we probably should have been fastening her seat -- that we waited until as a society we wait until there was no law passed before we actually. Buckled up. And we still to be reminded to buckle up so I believe that the government does pass some laws that do protect us from ourselves but. At some point it just gets to be a little ridiculous. Yeah it does and at the same time you know people. Why not stop turned into drugs but they still do at this point on the wallet fattening people don't eat drink and drive is still drive about seatbelts.
